Can a Pennsylvania employer fire an employee without cause?
Generally yes. Pennsylvania is an at-will employment state, which means an employer can terminate an employee at any time, for any reason or no reason — and an employee can likewise leave at any time. But "at will" is not "for any reason at all," because several important exceptions can turn a termination into a lawsuit.
The exceptions that create liability
- Discrimination — firing based on a protected characteristic;
- Retaliation — firing for protected activity, like reporting harassment or filing a claim;
- Contract — an employment agreement or policy that limits at-will termination; and/or
- Public policy — a narrow exception for firings that violate a clear public policy.
How employers reduce the risk
Consistent documentation, even-handed policies, and a clean process make a lawful termination defensible. Where there is any risk, a severance agreement with a release can close the door on future claims.
