What is an injunction?
An injunction is a court order that requires a party to stop doing something (or, less often, to do something) to prevent harm. Unlike a damages award that compensates after the fact, an injunction is about preventing an injury that money could not adequately fix — before it happens or continues.
Temporary restraining order (TRO) vs. preliminary vs. permanent
- TRO — emergency, short-term relief to hold the status quo, sometimes granted very quickly;
- Preliminary injunction — relief that lasts through the litigation, after a hearing; and/or
- Permanent injunction — final relief entered as part of the judgment.
What it takes to get one
Courts do not grant injunctions lightly. A party generally must show a strong likelihood of success, that it will suffer immediate and irreparable harm without the order, that the balance of harms favors relief, and that an injunction serves the public interest. Speed and a well-supported record are everything — these matters move fast.
